Terms of Use
1. Scope of Terms of Use
These Terms govern the relationship between Oriontil Tecnologia da Informação Ltda., the provider of Placevox, and the person or persons who use the service provided by Placevox (hereinafter called user or users). The use of the services implies acceptance of these Terms. If you do not agree with these Terms, you should not use Placevox.
These Terms encompass the use of Placevox by any means through which the service is offered, whether through a website, mobile device application, or any other means that may become available.
Whenever there is a reference to rights, duties, restrictions, or obligations of Placevox in these Terms, it is understood that the person legally capable of responding for such rights, duties, restrictions, or obligations is Oriontil Tecnologia da Informação Ltda.
2. Responsibility of Representatives
If the user is not considered legally capable according to the laws of the location from where they are accessing Placevox services, they must obtain express consent from their legal guardian to use the services. If you do not obtain express consent from your legal guardian, you may not use Placevox. Use of the service by users who are not legally capable is considered use consented to by their legal guardians.
Persons who do not have legal permission to use Placevox services, in accordance with the laws of the location from where they are accessing such services, must refrain from using Placevox.
If the user uses Placevox as a legal representative of any company or entity, it is considered that the said company or entity agrees and is aware of the use.
The represented parties are also considered responsible for the acts practiced by their legal representatives when using Placevox services.
3. Creation of Personal Space and Use of Email and Password
To begin using Placevox services, it is necessary to create a space (thus called the location where the user interacts with Placevox and hereinafter called Personal Space). For this, the provision of an email and a password is required. The user is responsible for keeping their password secret. Placevox cannot be held responsible for any damage caused to the user if there is negligence on their part in safeguarding their password.
It is the user's responsibility to provide a valid email address when creating their Personal Space in Placevox. This email will be used by Placevox in case of the need to recover a forgotten password and will also be used to alert about changes to these Terms or the privacy policy, in addition to other messages that the user agrees to receive.
4. Responsibility in Personal Space
The user is the sole administrator of their Personal Space and is responsible for all content inserted and all actions taken within it, together with the represented party, as per item 2. If the user verifies that their Personal Space has been compromised, they should contact Placevox at contact@placevox.com
5. Use of Personal Space
The user is the owner of their Personal Space and the content they add to it. Placevox exercises no control over the administration or use of the space by its creator, except in cases specified in these Terms.
6. Content
Content may be texts, videos, images, audio, or any other data that can be added by users to their space. The primary way to add content to a space is through a post.
Placevox holds no rights over the content added by the user and cannot use it for any purpose, including sharing or transferring to third parties, without the express agreement of the user responsible for its addition.
7. Modules
Modules are new functions that the user can add to their space. They may be for creating new utilities in the system (such as a calendar), for improving post editing (formatting, adding images), for affecting the organization or display of posts (folders, tags), among others that may be made available.
The Terms of Use apply in the same way to modules made available by Placevox.
Some modules may be paid. Before using a module, the user must read the description. The description binds both the user and Placevox. The user should be aware of the effect that the later deletion of that module will cause. Each module specifies what happens if it is deleted by the user. Placevox is not responsible for damages caused by inadvertent deletion of any module by the user.
8. Misuse of Placevox
Misuse of Placevox is considered any of the following conducts, in addition to others provided for in these Terms:
- Using any means to invade or attempt to invade Placevox databases with a view to accessing data of third parties;
- Attempting, by any means, to gain unauthorized access to data of third parties using Placevox services;
- Using any means to prevent or attempt to prevent third parties from having access to their own data, including using data extortion tools;
- Using Placevox services in a manner different from that made available, creating and/or providing tools that alter or create new functionalities in an unauthorized manner;
- Exploiting failures or vulnerabilities in the service with a view to obtaining privileges or profit for yourself or for third parties;
- Using in an unauthorized manner the name and brand Placevox with the objective of obtaining advantage for yourself or for third parties, especially by impersonating a Placevox representative without being duly authorized to do so;
- Using any means or form to promote any type of attack on Placevox systems with a view to destabilizing the service or affecting its normal functioning.
The practice of any of the above conducts may result in criminal and civil consequences for the practice of unlawful acts, including possible payment of damages required by third parties for violation of their rights.
If it is established that the user used Placevox services solely for the purpose of practicing any of the conducts provided for above, in addition to other conducts harmful to third parties or to Placevox itself contained in these Terms, access to their space may be revoked, with means of defense ensured.
9. Deletion of Spaces
Placevox provides a link for space deletion in a simple and quick manner.
The deletion of space results in the deletion of all data inserted in it, whether content, modules, or any others that may be added by the user. Deletion is permanent and deleted data is completely erased from Placevox servers and is not recoverable.
Removal of the application from the smartphone or logout in the system does not result in space deletion; it is necessary to use the option specifically provided.
Placevox will only erase content or delete any space without user interference if there is a legal or judicial determination for it to do so and if it determines that maintaining the content or space will cause irreparable harm to third parties or to the community. Spaces may also be deleted in case of termination of services. To learn how spaces are handled in the event of service termination, consult item 14 of these Terms.
10. No Warranty
Placevox seeks to offer services free of failures using the best possible techniques and tools, but does not guarantee that such failures cannot occur, which may result in errors in using the service, temporary interruptions, or, in extreme cases, data loss, which Placevox will seek to minimize or prevent in the best way possible.
Placevox is not responsible for any damages that may occur as a result of misuse of the services or arising from fortuitous cases, force majeure, accidents, or other events of that nature.
11. Termination of Services
Placevox may, for reasons of force majeure, terminate its services at any time. To avoid loss of data and content that the user has entrusted to Placevox, a tool will be provided so that all data can be copied in a format that can be easily accessed.
To enable data copying, Placevox will offer a reasonable time before terminating the services. This time, except in unavoidable situations, will not be less than 30 days.
12. Changes to Terms of Use
These Terms of Use may be changed at any time by Placevox. Whenever this occurs, a message will be sent to the email used to create the Personal Space. If you do not wish to receive messages, the user can cancel receipt using the link provided in the message itself, but in that case should regularly visit this page to become aware of modifications.
By continuing to use Placevox after the changes, the user agrees to and accepts the modifications made.
13. Privacy
The privacy of data provided by users is addressed in the Privacy Policy, a document that is part of these Terms.
