Terms of Use
1. Scope of the Terms of Use
These Terms govern the relationship between Oriontil Tecnologia da Informação Ltda., the provider of Placevox, and the person or persons utilizing the service provided by Placevox (hereinafter referred to as the "User" or "Users"). Using the services implies full acceptance of these Terms. If you do not agree with these Terms, you must not use Placevox.
These Terms encompass the use of Placevox through any medium by which the service is offered, whether via website, mobile application, or any other platform that may be made available.
Whenever reference is made to the rights, duties, restrictions, or obligations of Placevox in these Terms, it is understood that the legal entity responsible for such rights, duties, restrictions, or obligations is Oriontil Tecnologia da Informação Ltda.
2. Liability of Representatives
If the User is not considered legally competent under the laws of the location from which they are accessing Placevox services, they must have the express consent of their legal guardian to use the services. Without the express consent of their legal guardian, they are prohibited from using Placevox. The use of the service by users who are not legally competent shall be deemed as use consented to by their legal guardians.
Persons who are not legally permitted to use Placevox services under the laws of the location from which they access such services must refrain from using Placevox.
If the User utilizes Placevox as the legal representative of a company or entity, it is deemed that said company or entity agrees to and is aware of such use. The represented entities are also held liable for the acts performed by their legal representatives when utilizing Placevox services.
3. Creation of the Personal Space and Use of Email and Password
To begin using Placevox services, you must create a space (defined as the location through which the User interacts with Placevox, hereinafter referred to as the "Personal Space"). This requires providing an email address and a password. The User is responsible for keeping their password confidential. Placevox cannot be held liable for any loss or damage caused to the User due to negligence in safeguarding their password.
The User is responsible for providing a valid email address when creating their Personal Space on Placevox. This email will be used by Placevox if the User needs to recover a forgotten password, and it will also be used to alert them about changes to these Terms or the Privacy Policy, in addition to any other messages the User agrees to receive.
4. Liability within the Personal Space
The User is the sole administrator of their Personal Space and is responsible for all content inserted and all actions performed within it, jointly with the represented entity pursuant to Section 2. If the User notices that their Personal Space has been compromised, they must contact Placevox at contact@placevox.com.
5. Use of the Personal Space
The User owns their Personal Space and the content they add to it. Placevox does not exert any control or interference over the administration or use of the space by its creator, except in the specific cases outlined in these Terms.
6. Content
Content may consist of text, videos, images, audio, or any other data that Users can add to their space. The primary method for adding content to a space is through a post.
Placevox holds no rights over the content added by the User and cannot use it for any purpose, including sharing or transferring it to third parties, without the express consent of the User responsible for adding it.
7. Modules
Modules are new features that the User can add to their space. They may serve to create new system utilities (such as a calendar), improve post editing (formatting, adding images), or affect the organization and display of posts (folders, tags), among other features that may be made available.
These Terms of Use apply in the same manner to the modules provided by Placevox.
Some modules may be paid. Before using a module, the User must read its description. The description binds both the User and Placevox. The User must be aware of the consequences that a subsequent deletion of that module will entail. Each module specifies what happens if it is deleted by the User. Placevox is not liable for any losses caused by the inadvertent deletion of any module by the User.
8. Misuse of Placevox
The following actions, among others provided in these Terms, constitute misuse of Placevox:
- Using any means to breach or attempt to breach Placevox databases in order to access third-party data;
- Attempting, by any means, to gain unauthorized access to the data of third parties using Placevox services;
- Using any means to prevent or attempt to prevent third parties from accessing their own data, including the use of ransomware or datahijacking tools;
- Utilizing Placevox services in a manner different from how they are provided, including creating and/or distributing tools that alter or create new features in an unauthorized way;
- Exploiting flaws or vulnerabilities in the service to obtain privileges or advantages for oneself or third parties;
- Utilizing the Placevox name and trademark without authorization to obtain an advantage for oneself or third parties, particularly by impersonating a Placevox representative without proper authorization;
- Using any means or form to launch attacks against Placevox systems with the intent to destabilize the service or disrupt its normal operation.
Engaging in any of the above behaviors may lead to criminal and civil consequences for unlawful acts, including the potential payment of damages required by third parties for violating their rights.
If it is established that the User utilized Placevox services solely to engage in any of the prohibited conducts listed above, or other harmful actions toward third parties or Placevox contained in these Terms, their access to the space may be revoked, with appropriate means of defense guaranteed.
9. Deletion of Spaces
Placevox provides a simple and quick link to delete your space.
Deleting a space results in the permanent removal of all data inserted within it, whether content, modules, or any other items added by the User. Deletion is final, and the removed data is completely wiped from Placevox servers and cannot be recovered.
Removing the application from a smartphone or logging out of the system does not delete the space; you must use the specific option provided within the platform.
Placevox will only delete content or remove a space without the User's intervention if there is a legal or judicial mandate to do so, or if it determines that maintaining the content or space will cause irreparable harm to third parties or the community. Spaces may also be deleted in the event of service termination. To understand how spaces are handled upon service termination, please refer to Section 11 of these Terms.
10. Disclaimer of Warranties
Placevox strives to offer flaw-free services utilizing the best available techniques and tools, but it does not guarantee that flaws will never occur. This may result in usage errors, temporary interruptions, or, in extreme cases, data loss, which Placevox will seek to minimize or prevent to the best of its ability.
Placevox is not liable for any losses that may occur due to the misuse of its services, or resulting from acts of God, force majeure, accidents, or other events of a similar nature.
11. Termination of Services
Placevox may, due to force majeure, terminate its services at any time. To prevent the loss of data and content that the User entrusted to Placevox, a tool will be provided so that all data can be copied into an easily accessible format.
To facilitate this data copy, Placevox will provide a reasonable timeframe before terminating the services. Unless an unavoidable situation arises, this period will not be less than 30 days.
12. Changes to the Terms of Use
These Terms of Use may be modified at any time by Placevox. Whenever this happens, a notification will be sent to the email address used to create the Personal Space. If the User does not wish to receive these emails, they can unsubscribe using the link provided in the message itself; however, in this case, they should check this page regularly to stay informed about any updates.
By continuing to use Placevox after changes take effect, the User agrees to and accepts the updated terms.
13. Privacy
The privacy of the data provided by Users is addressed in the Privacy Policy, a document that constitutes an integral part of these Terms.
